Buried Truth: How Ireland’s Whistleblower Law Was Silenced — and the Constitution Betrayed.

For over a decade, Ireland’s whistleblower framework — the Protected Disclosures Act 2014 — was presented as a landmark of transparency.
But my academic research uncovered something far darker.

The 2014 Act was never lawfully operationalised.
State bodies failed to provide independent reporting channels, breached confidentiality, and denied whistleblowers access to justice.

Instead of correcting these illegalities, the Protected Disclosures (Amendment) Act 2022, under Minister Michael McGrath, retrofitted legality onto an unlawful system — effectively rewriting history to protect the State from accountability.

What followed was one of the most complex and calculated acts of legislative concealment in modern Irish history.

My research paper exposing this — detailing constitutional breaches under Articles 15.2, 34, and 40.3 of the Irish Constitution, and violations of EU Directive 2019/1937 — was obstructed, suppressed, and never allowed to reach a court.

Today, that paper exists only as an exhibit — buried by design.

Meanwhile, the creation of the Protected Disclosures Commissioner’s Office has consolidated unprecedented powers over evidence, process, and access — ensuring that uncomfortable truths remain unseen.

This is not conjecture.
It is evidence — evidence of how a government framework can be manipulated to hide its own illegality.
